Rosal: I will continue to serve as Albay governor
Albay Governor Noel Rosal said that he will continue to serve as governor as the decision of the Commission on Elections first division disqualifying him is not yet final.
Rosal’s legal geam said that thet have five days from the receipt of the decision to filed a motion for reconsideration before the Comelec en Banc.
“The Resolution of the First Division is NOT final and executory. We have 5 days from receipt or up to 24 September, to file MR to the Commission En Banc,” said Rosal’s legal team.
“The Decision, Final Order or Ruling of the Comelec En Banc may be brought to the Supreme Court on Petition for Certiorari under Rule 65 in relation to Rule 64 of the Rules of Court but becomes executory after 5 days if no restraining order is issued by SC,” they added.
The Comelec first division earlier disqualified Rosal from the provincial race for supposedly violating the 45-day ban on the release of public funds by government agencies.
This stemmed from Rosal’s approval of cash assistance payout to tricycle drivers in Apri when he was Legazpi Mayor.
“I WILL CONTINUE TO FUNCTION AS YOUR GOVERNOR UNTIL THE COURT ORDERS WITH FINALITY AND EXECUTORY TO VACATE THE POSITION.. STAY CALM TABI .. SALAMAT PO SA GABOS NA NAGASUPORTA,” said Rosal.
The petition against Rosal filed by defeated Legazpi City councilor bet Joseph Armogila.
