Masbate BM Arevalo weighs on quo warranto petition vs ABS-CBN franchise
Masbate Provincial Board Member Jason Arevalo has weighed on the substantial issues presented by the Office of the Solicitor General on the move to void the franchise of ABS-CBN.
The OSG earlier filed a quo warranto petition before the Supreme Court against ABS-CBN for the alleged violations on its legislative franchise.
“Albeit I am more inclined to believe [based on my understanding as a lawyer and former banker] that PDRs are mere investment mechanisms to augment the capital of the solicitor but where such equity participation is limited to a certain percentage; and where such investments are only entitled to the dividends but bereft of any voting rights as regular stockholdings are entitled to, others opine that such equity participation is tantamount to control or the opportunity to control,” Arevalo said.
“If we hold the latter view to be true, then the issue of control must be proved as a fact,” he added.
The lawyer turned politiko said that evidence tending to prove it must be substantial and offered.
“Barring such, doubts as to the true nature of the PDRs, especially if solicited from and invested by foreign sources, must be resolved in favor of the right to speech and its free exercise,” he said.
