Di kasi nagmadali: Ombudsman’s delay results in dismissal of graft raps vs. Sorsogon mayor
Since it took the Office of the Ombudsman to file the case, the Sandiganbayan 1st Division has dismissed the graft charge against Bulan, Sorsogon Mayor Helen de Castro for her alleged failure penalize a construction company with over P140,000.
“The court is constrained to decree the dismissal of the present case for violation of the accused-movants’ constitutional right to a speedy disposition of their case,” read the 1st Division’s resolution which granted her motion to quash.
The anti-graft court pointed out that it took the Ombudsman almost 10 years before the case was filed before the Sandiganbayan.
Records show S.R. Baldon construction was delayed in the installation of an additional 25kva electric transformer in the municipality’s main terminal building in 2007.
Despite this, de Castro is accused of giving unwarranted benefit to S.R. Baldon Construction by failing to issue an order to deduct P145,770.60 from the firm due to the delay.
